Under RBMC Title 5, Chapter 2, it is unlawful for any person to throw, place, or deposit upon any public or private street, sidewalk, or alley, or upon any park or public place, any rubbish, garbage, or similar material or litter. The same prohibition applies to drivers and passengers throwing litter from vehicles. It is also unlawful to allow any dumpster to remain on any public street, alley, sidewalk, or highway without authorization. Because the City grants Athens Services an exclusive franchise, the anti-scavenging section makes it unlawful for any unauthorized person to remove refuse or recyclables placed out for collection; once at the curb, those materials belong to the City. Complaints go to Code Enforcement and Police.
Illegal dumping, littering, unauthorized dumpsters, and scavenging of set-out refuse or recyclables violate RBMC Title 5 and may be prosecuted as misdemeanors or infractions, with citations, fines, and cleanup-cost recovery.
