In the City of Youngstown, Ohio, § 521.08 of the Codified Ordinances bans placing or disposing of litter or miscellaneous debris, including paper, cigarette butts, garbage, rubbish, refuse, tires, or construction material, on any public property or on any private lot the dumper does not own or control, unless that property is properly licensed by the State as a landfill or solid waste depository. Subsection (d) makes clear this is a strict liability offense: Council intended §§ 521.08 through 521.083 to control a nuisance that threatens public health, safety and welfare, and lack of knowledge or intent to dump illegally is not a defense.

Enforcement runs through the Police Department, the Health Department, and the Litter Control Department under § 521.083, and where a property owner does not remove a dumped nuisance within three days of notice from the Health Commissioner, the City can abate it and bill the owner the cost of removal under §§ 521.081 and 521.082, calculated from the prevailing wages of City abatement personnel and equipment. The criminal penalty sits at § 521.99: a violation of § 521.08(b) or (c) is an unclassified misdemeanor punishable by up to six months of incarceration and a fine of up to $1,000.00, or both.

A judge may treat a defendant's willingness to perform community service in the Litter Control Department as a mitigating factor at sentencing, but the court must still order restitution to the City for the cost of removing or abating the dumped material and cleaning up the site if the City performed that work. Residents who help build these cases can also earn a reward of up to $250.00 under § 521.085 by reporting information to the Police Chief, Health Commissioner, or Street Department Superintendent that leads to a conviction.
