Adopted by Ordinance 22-07 on April 5, 2022 to implement Senate Bill 1383's statewide organic-waste diversion mandate, Sec. 4 requires responsible parties of single-family dwellings to subscribe to and pay for the franchisee's three-container collection service for weekly pickup of recyclable materials, organic materials and solid waste, and to place source-separated organic materials including food waste in the organic container, recyclables in the blue container, and refuse in the black container, while directing that prohibited contaminants never go in the wrong stream. The City reserves the right to review a household's container number and size and require service-level adjustments.

Enforcement is layered under Sec. 13: when the City spots prohibited contaminants in a container, it issues a notice of contamination, typically a cart tag, and repeat contamination can trigger contamination processing fees or penalties. 4, with base penalties of $50 to $100 for a first violation, $100 to $200 for a second, and $250 to $500 for a third or subsequent violation, with the exact amount set using factors like willfulness, ability to pay, and any economic benefit gained. Compliance deadlines can be extended for Acts of God, permitting delays, or CALRecycle-related infrastructure gaps, and a recipient may request a hearing to appeal any citation.
