Brookhaven, NY Trash & Recycling: Recycling Requirements (2026)

Section 46-9A requires all commercial, industrial and institutional establishments within a garbage district or area subject to the curbside program to "source separate and arrange for the collection for recycling" of newspaper within 180 days of the curbside program's establishment, and of any other designated recyclable added later within 180 days of that addition. Subsection B lists the required materials: newspaper; high-grade paper (white letterhead, bond, typing, copier, notepad, writing paper, envelopes without glassine windows, computer printout and tab cards, onion skin); corrugated cardboard; glass containers, plastic containers and cans generated by food and beverage service establishments; vegetative yard waste; and any other material the Town Board later designates by resolution.

Section 46-9C places the arrangement duty on the "generator", the person who owns, manages or operates the establishment, or the party contractually obligated to it, and allows compliance through direct marketing, hauler contracts, or direct delivery to a designated processing facility. Section 46-6 separately requires all designated recyclables to be prepared for collection per Commissioner-issued regulations, and § 46-13 lets the Town or its collectors refuse pickup of solid waste that has not been properly separated from recyclables.
