Before removing any protected tree, property owners must obtain a tree removal permit from the Building Inspection Division. The ordinance requires mitigation for removed protected trees, which can be accomplished by planting replacement trees on-site or paying into the city's Tree Reforestation Fund. Replacement ratios are based on the size of the removed tree. During construction, protective barriers must be placed around the critical root zones of trees to prevent damage from heavy equipment, grade changes, or soil compaction. Single-family residential properties with existing homes can remove up to two protected trees per 12-month period without full mitigation requirements, though a permit is still needed. The city's Urban Forester oversees administration of the ordinance.
Removing a protected tree without a permit is a misdemeanor offense with fines of $500 to $2,000 per tree. Damage to protected trees during construction can result in fines equal to the appraised value of the tree. Repeat violations may result in higher penalties and injunctive action by the city.
