San Clemente permits accessory dwelling units ministerially under SCMC 17.28.270, implementing California Government Code Sections 65852.2 and 65852.22. Qualifying ADUs and junior ADUs are approved with a building permit only, with no discretionary hearing.
SCMC 17.28.270 sets the ADU standards. A conforming ADU or JADU may not be deemed inconsistent with the general plan or to exceed allowable density. A detached ADU generally may not exceed 16 feet in height, rising to 18 feet within one-half mile of a major transit stop. Detached new-construction ADUs need only 4-foot side and rear setbacks, and no setback applies to a garage conversion.
