Laguna Niguel Municipal Code Section 9-1-35.4 governs garages, carports, and driveways. A carport is permitted only after approval of a minor adjustment and must meet the district's setback and height standards in Table 3.3, including a 35-foot maximum structure height.
Under LNMC 9-1-35.4, garages and carports are structures with direct access to a street or alley, and carports are permitted only upon approval of a minor adjustment under paragraph (b). Detached garages and carports must conform to the development standards for main buildings and cannot sit within any corner cutback area for fences under 9-1-35.2. Dimensional standards are set in Table 3.3, which lists a 35-foot maximum height across the RS-1 through RS-4, RA, and RM districts, front setbacks of 17 to 20 feet, side setbacks of about 5 to 8 feet, rear setbacks of 10 to 25 feet, and a 20-foot minimum driveway. Side-entry garages may reduce the front setback to 10 feet with a minor adjustment.
Building a carport without the required minor adjustment, or violating the Table 3.3 setbacks or 35-foot height, violates LNMC 9-1-35.4. The Community Development Department may require the minor adjustment, relocation to meet setbacks, or removal of a non-conforming carport.
