East Orange, NJ Building Safety: Childcare Center Rules (2026)

East Orange treats child-care centers as a state-mandated permitted use. Section 51-91, tracking N.J.S.A. 40:55D-66.6, makes a licensed child-care center (licensed by the Department of Human Services under N.J.S.A. 30:5B-1 et seq.) a permitted use in every nonresidential zoning district in the City, and the floor area the center occupies is excluded both from the building's otherwise-applicable parking calculation and from the density allowed for that structure under the zoning ordinance. Where a zoning district instead lists child-care centers as a conditional use, § 51-138 layers on dimensional standards: a minimum lot size of 15,000 square feet, minimum lot width and depth of 100 feet each, a front yard matching the average setback of buildings within 200 feet on either side, 10-foot side yards, a 10-foot rear yard, a height limit of two-and-a-half stories or 35 feet, and maximum lot coverage of 35%.

Two safety-driven conditions apply on top of the dimensional table: any outdoor play area must be secured, designed, and located to assure child safety, and the site must provide an on-site queuing area capable of holding at least four cars so that parent drop-off and pickup does not spill onto the street. Centers must also comply with all separate New Jersey state licensing requirements administered by the Department of Human Services.
