Irving, TX Building Safety: Childcare Center Rules (2026)

Under Chapter 13 of the Code of Civil and Criminal Ordinances, a person may not own, operate, administer, manage, direct, advertise, or control a child-care facility in Irving without a valid permit from the inspections department (§ 13-3(a)). The permit requirement covers facilities licensed or registered by the state under Human Resources Code Chapter 42, parent's day out programs, and city-operated youth programs. Applicants submit a completed application, a copy of the state license or proof it was applied for, any state variances, and for centers, a certificate of occupancy application, the director's state certification, and documentation of licensed capacity (§ 13-4(a)).

Permits run one year and are not transferable between owners or locations (§ 13-3(d), 13-4(d)). 00 late fee, and a permit delinquent more than 30 days may be suspended or revoked (§ 13-5(b), (d)). The director may suspend or revoke a permit for violating the chapter, must revoke it if the state permit is revoked, and can reinstate a suspended permit once the facility is back in compliance (§ 13-6).

Facilities must also pass a gas leak test every two years, provide one off-street parking space per ten children served at any one time, and test staff for tuberculosis within seven working days of hire (§§ 13-11, 13-12, 13-13). Annual inspections are conducted by the health division of the inspections department, which may enter the premises at reasonable times and access records (§ 13-8).
