Section 8B-30, adopted by Ordinance 2025-11128 on July 31, 2025, applies to new multifamily and residential mixed-use construction, to any commercial building undergoing substantial reconstruction into multifamily use, and to any existing multifamily structure undergoing substantial reconstruction, defined as demolishing or rebuilding fifty percent or more of the gross floor area, or replacing fifty percent or more of the exterior walls and roof assembly. Interior renovations and ordinary maintenance are excluded. Projects already approved through a development agreement, site plan zoning, or a transit-oriented-development concept plan before August 30, 2025 are exempt until September 1, 2030.
5 gallons per minute for showers, and one gallon per minute for faucets, plus rainwater and graywater reuse readiness and smart irrigation controllers; high-albedo, hail-resistant roofing; a minimum seventy-five percent diversion rate for construction and demolition waste; bicycle parking at one space per five units and electric-vehicle readiness for at least fifteen percent of parking; and CPTED lighting and landscaping standards, including full cut-off fixtures at a minimum one footcandle and shrubs kept to three feet or lower near entries. Where a future ICC code cycle conflicts with these local enhancements, Section 8B-30(b) directs that the most stringent regulation controls.
Violations & Fines
Section 8B-30 does not carry its own penalty clause, so a project that fails to meet the enhanced energy, water, roofing, waste-diversion, or CPTED standards is enforced through Chapter 8B's general building-code penalty in Section 8B-28: a Class C misdemeanor fined up to five hundred dollars per offense, or up to two thousand dollars if the violation involves fire safety or public health, with each day of noncompliance a separate offense, and the building official can withhold certificates of occupancy pending compliance.
