Section 9-1-45.24 sets requirements that apply to every child day care center or preschool in a nonresidential district, regardless of how many children the facility serves. First, the operator needs a use permit under § 9-1-114, reviewed by the planning commission at a public hearing under § 9-1-114.2, and any facility must comply with both the zoning section itself and whatever additional conditions the use permit or any other required permit imposes. Second, every facility must operate in accordance with state and local health, safety, and other regulations, which brings in licensing requirements beyond the zoning code itself.

Third, outdoor activities are limited to the hours between 8:30 a.m. and 7:00 p.m., a specific window meant to limit noise and activity spilling into surrounding properties outside the school day. Fourth, every facility must provide an onsite pickup and dropoff area, plus either an onsite vehicle turnaround or separate vehicle entrance and exit points, addressing the traffic and queuing problems that concentrated drop-off and pick-up times create at a day care. Parking, signage, and outdoor lighting for the facility must comply with the general nonresidential standards in subarticles 6 and 7 and with the outdoor lighting standards of § 9-1-45.14, and the facility's building and site itself must meet the development standards, such as setbacks and height, that apply to whatever district it sits in under § 9-1-43. Because the use permit is discretionary, the planning commission can add project-specific conditions addressing traffic, noise, or hours beyond this baseline list.
