Passaic, NJ Building Safety: Carbon Monoxide Detectors (2026)

Section 219-86, added in 1984 and last amended in 2004, makes carbon monoxide detection mandatory alongside smoke detection in every multiple dwelling: subsection A requires the owner to install smoke detectors and/or smoke alarms and carbon monoxide detectors that conform to Section 5:10-25.3 of the New Jersey Administrative Code, or any additional state regulation the state later adopts. Maintenance duties are then assigned by location and notice: under subsection B, the owner, landlord or agent is solely responsible for keeping detection systems or devices in common areas in good working order at all times, while responsibility for single-station units inside individual dwelling units attaches to the owner once the tenant has given notice under N.J.A.C.

5:10-25.3(d) that the unit is malfunctioning, or once the City itself has notified the owner of a malfunction. Subsection C fixes repair deadlines, 24 hours to fix or replace a single-station unit, 72 hours for a multiple-station, electrically wired system. Subsection D makes it a violation for a tenant to skip regular testing of the units in the tenant's own unit or to fail to notify the owner of a problem as N.J.A.C. 5:10-25.3(f) requires, and subsection E imposes a minimum $100 fine on any tenant who willfully or maliciously damages, disables or removes a smoke- or carbon-monoxide detection system or device, whether in their own unit, another unit, or a common area.
