Article VIII of Chapter 89 adopts the U.S. Green Building Council's LEED-NC Rating System, Version 2.2 and later USGBC updates, under § 89-84, and applies it under § 89-85 to all new commercial, office, industrial, multiple residence and senior citizen multiple residence construction of 4,000 square feet or larger. Section 89-86 requires every such applicant to file a completed LEED-NC checklist and pay a fee of $0.03 per square foot, capped at $15,000, into the Town's Green Building Fund, refunded if the project reaches LEED certification, and it blocks issuance of the building permit itself until the documentation shows the project will attain that certification.
