Full Breakdown
Naperville Municipal Code § 6-2-26 governs single-family detached homes and duplexes built on lots resubdivided or platted before 1989, or resulting from demolition and large additions, once a building permit application was accepted after February 15, 2005 for single-family homes or July 5, 2005 for duplexes. Regardless of what the underlying R1, R1A, R1B, or R2 zoning district otherwise permits, these teardown and infill structures are capped at two and one-half stories and thirty-five feet, with a maximum roof peak of forty feet.
Violations & Fines
Building permits that exceed the height cap are denied at plan review; a structure built noncompliant is a zoning violation subject to Naperville's general penalty of $100 to $500 per day (§ 1-4-1).
