Violations & Fines

Exceeding the coverage percentage is a violation of § 300-60.6.1. Under § 300-60.7 a conviction carries a fine up to and not to exceed $250, up to 15 days in jail, or both, and each day the violation continues is a separate violation. The owner also bears the Town's attorney, engineering, consultant and court costs, which can be levied on the property as a lien. The Zoning Board of Appeals decides variance applications under § 300-69.3.
