Violations & Fines

Building inside a required setback is a violation of § 300-60.6.1. Under § 300-60.7 a conviction carries a fine up to and not to exceed $250, up to 15 days in jail, or both, and each day the violation continues counts as a separate violation. The Town's attorney, engineering and consultant fees and court costs also become the owner's obligation and can be levied against the property as a lien. A variance is the legal route to a smaller setback, and the Zoning Board of Appeals holds final authority over variance applications under § 300-69.3.

Yes. Section 300-10.4 applies the Consolidated Zoning Ordinance to all development within the corporate limits of the Town of Union and the Villages of Endicott and Johnson City unless the ordinance says otherwise. Can a bay window or chimney project into a setback?
Eaves, gutters, chimneys and bay windows cannot project more than three feet into the street setback under § 300-53.4, and the same three feet applies to side and rear setbacks in a residential district under § 300-53.5. Uncovered landings can reach five feet and open fire escapes four feet into the street setback. Covered porches count as structures when the setback is measured.
Can my front setback be smaller than the table says?
Section 300-53.1 allows it on a built-up block. Where 50 percent or more of the street frontage on one side of the block, measured 250 feet each way from your lot, is occupied by buildings and their average street setback is less than the district minimum, new construction uses that average. Otherwise a variance from the Zoning Board of Appeals is needed.
