Full Breakdown
Section 1004.09(b) of the Roseville City Code sets yard setbacks for the Low Density Residential (LDR) district in Table 1004.09. The minimum front yard building setback is 30 feet and the minimum rear yard setback is 30 feet. Interior side yards are 5 feet and corner side yards are 10 feet. On a reverse corner lot the side setback is equal to the existing front yard of the adjacent lot, but not greater than 30 feet. One value applies across the one-family, two-family and courtyard cottage columns.
Three footnotes change the result. Footnote a points to section 1004.04: if existing houses on 50 percent or more of the frontage of any block have a predominant front yard setback less than the minimum required in the chapter, new construction on that block frontage can use a reduced front yard setback equal to the average front yard setback of the two adjacent houses on the same side of the street. Footnote b says covered entries and porches sheltering (but not enclosing) front doors are encouraged and can extend into the required front yard to a setback of 22 feet from the front property line. Footnote c applies the corner side yard requirement wherever a parcel is adjacent to a side street or right-of-way, and lets the Community Development Department reduce the required setback from an unimproved right-of-way to the interior side yard setback once the public works director determines the right-of-way is likely to remain undeveloped.
The Low to Medium Density Residential (LMDR) district in section 1004.10 uses its own table. It keeps a 30-foot street front yard and a 30-foot rear yard, adds a 10-foot interior courtyard front setback, and sets interior side yards at 5 feet and corner side yards at 10 feet for one- and two-family lots. For three- and four-family lots and for attached and courtyard cottage lots, the interior side setback is 8 feet at an end unit and the corner side setback is 15 feet. Detached sheds and garages follow separate setbacks in Table 1004.02.
Violations & Fines
Section 1002.02 makes it a misdemeanor to violate, neglect or refuse to comply with any provision of Title 10, and each day a violation continues is a separate offense. Under section 102.01(a), unless the Code provides otherwise, the penalty is a fine not to exceed $1,000.00, imprisonment not to exceed 90 days, or both, plus costs of prosecution. A building placed inside a required yard breaks the Table 1004.09 minimums.
