Section 9.24.110 governs the current, non-expired regulation of sexually oriented businesses (a prior § 9.24.100 imposed only a 120-day moratorium in 2002). Under § 9.24.110(E) and (G), sexually oriented businesses, including adult cabarets, adult motion picture theaters, adult media stores and sex shops, may operate only in the C-4 (highway business), M-1 (limited industrial) and M-2 (general industrial) zoning districts, and are disallowed everywhere else in the city. Subsection C requires a 300-foot separation from tax-exempt religious and K-12 educational property, named public parks (Dallason, Long and Hardin) and recreation facilities, public libraries, licensed child care facilities, hospitals providing inpatient care, and every residential zoning district (R-1 through R-6), measured in a straight line from lot line to lot line, plus a 300-foot separation from any other sexually oriented business.

Subsection D imposes physical design standards: no video reproduction equipment in restrooms, sufficient overhead lighting throughout patron areas, exterior lighting of the full building and parking lot perimeter, single occupancy per video-viewing booth, and booth partitions at least six feet tall and three and a half feet wide with no openings between booths. Subsection E requires any live performance to occur on a stage at least thirty-six inches above the customer floor with patrons seated no closer than five feet, bars customers from the stage, and specifically prohibits "lap dancing" or "friction dancing." Subsection F bars any sexually oriented business from publicly displaying explicit sexual material, including on signage.

Subsection G(6) flatly bans "touching and encounter businesses," defined as establishments allowing direct physical contact between an entertainer and a customer in a closed booth or room, in every zoning district in the city with no exception.
