Casper, WY Business Licensing & Operations: Secondhand Dealers (2026)

Section 5.36.010 defines regulated secondhand property broadly to include electronic audio or video equipment, video gaming systems and cartridges, firearms, musical instruments, sports equipment, photographic equipment, sonar or radar devices, powered construction or mechanical tools, computers, cellular phones, jewelry, coins and precious metals, whether or not the item carries a serial number. The same section excludes flea markets, antique dealers, used furniture dealers, used car dealers, nonprofit organizations, auction houses and used clothing dealers from the secondhand dealer definition, along with owner consignment sales. Every dealer must file an application with the city clerk under Section 5.36.030 and pay a fee set by council resolution, and any change of ownership requires a brand-new license application.

Section 5.36.020(B) extends the same duty to out-of-city or out-of-state dealers doing temporary business in Casper, who must obtain the identical licensing documents and follow the same rules as local dealers. Section 5.36.070 requires dealers to log each transaction within twenty-four hours, including a description of the item and identification from the seller, and to keep those records for four years. Section 5.36.080 requires a fifteen-day holding period before any purchased item can be displayed or sold. Section 5.36.120 makes any violation of Chapter 5.36 a misdemeanor, punished under the general penalty schedule set out in Chapter 1.28 of the code.
