Flagstaff, AZ Business Licensing & Operations: Adult Entertainment (2026)

Chapter 3-08 licenses eleven classifications of sexually oriented business, including adult arcades, bookstores, cabarets, motels, theaters, escort agencies offering adult service, massage establishments offering adult service, nude model studios, and sexual encounter centers. Section 3-08-001-0004 makes it a class one misdemeanor to operate any of them without a valid Adult Oriented Business License, to employ an unlicensed worker at one, or to work at one without an individual Adult Oriented Business Employee License. Applications go through the City's Tax, Revenue and Licensing Division and must disclose ownership, a floor-plan diagram, and whether the applicant was convicted of a 'specified criminal activity' (a list running from prostitution and obscenity to child pornography and sexual assault) within the preceding five years for a misdemeanor or the preceding five years for a felony.

Fingerprints go to the Police Department, which may share results with the Arizona Department of Public Safety and the FBI. Section 3-08-001-0005 lets the City's Tax, Revenue and Licensing Administrator deny a license for an underage applicant, unpaid City taxes or fees, a prior denial or revocation within twelve months, a disqualifying conviction, or premises that fail health, fire, or building inspection. Location is separately restricted: Section 3-08-001-0012 bars operating in any zoning district other than as the City's zoning ordinances specify, treats each day of violation as a separate offense, and, citing A.R.S.

Section 13-1422(A), bars an adult oriented business from locating within one-quarter mile of a child care facility, school, playground, public recreational facility, residence, or place of worship, measured property-line to property-line. A business already lawfully sited does not violate the spacing rule if a protected use later moves within a quarter mile of it. Two or more such businesses sharing a building, unless at least 51% commonly owned, count as separate businesses for spacing purposes.
