City Code Chapter 53, Article VIII covers nine categories of sexually oriented business: adult arcades, adult bookstores or video stores, adult cabarets, adult motels, adult motion picture theaters, adult theaters, escort agencies, nude model studios and sexual encounter centers (Section 53-1161). Each needs a conditional use permit reviewed by the Planning and Zoning Commission and approved by the City Council, and Section 53-1162 confines every one of them to the CM or W zoning district. The 1,000-foot buffer runs from the nearest building wall or property line, in a straight line, ignoring intervening structures, to the nearest church, school, park, residential lot or residentially zoned boundary, and separately to the nearest wall of another sexually oriented business.

A business that shows adult films in a viewing room under 150 square feet must post an attendant at a manager's station with an unobstructed line of sight into every viewing area, keep the room lit to at least one footcandle, and never let more than one patron into a viewing room at a time (Section 53-1163). A lawfully operating business that becomes nonconforming because a protected use later locates nearby keeps its rights on permit renewal, but a business that itself falls out of compliance gets only two years to relocate or close, and loses its status immediately if it voluntarily shuts down for 30 or more days (Section 53-1166). Planning and Community Development administers the permit; Kyle Police Department handles complaints of unpermitted operation.
