Kyle, TX Business Licensing & Operations: Towing Companies (2026)

City Code Section 11-381 states that Chapter 11, Article IX exists to set requirements for voluntary participation of privately owned commercial towing and wrecker services with the City of Kyle, covering every towing company based in the city and any towing company, in or out of the city, that performs nonconsent tows within it. Section 11-381.1 makes compliance with V.T.C.A. Occupations Code Sections 2303.001 and 2308.001 a continuing prerequisite to stay on the city's rotation list, and requires each owner to hold a state license and permit for every tow truck under Occupations Code Sections 2308.101 and 2308.153.

To join the Kyle Police Department's wrecker rotation list, Section 11-389 requires an annual written application to the chief of police disclosing the company's address, business hours, number and type of wreckers, and whether the company wants rotation placement, along with proof of a state-licensed vehicle storage facility inside city limits or the city's extraterritorial jurisdiction; the application carries a $250.00 fee. Section 11-390 requires each wrecker be at least one ton with a gross vehicle weight of 10,000 pounds or more, carry a winch rated for at least 8,000 pounds single-line capacity, safety chains, a fire extinguisher, and the company's name and phone number lettered at least three inches high on both doors, and each rotation call must be answered 24 hours a day.

Section 11-387 bars any wrecker from responding to an accident scene unless called by the owner or the Kyle Police Department, and bars soliciting business at an accident site, with presence at the scene within an hour of the accident treated as evidence of a violation.
