Kyle, TX Business Licensing & Operations: Pawnbrokers (2026)

Kyle regulates pawnshops the same way it regulates massage businesses: through the zoning use table in Chapter 53 rather than a dedicated occupational license. Section 53-1230, Exhibit A, ties SIC code 5222-9800, listed as 'Pawn shops,' to Primary Zoning CBD-2 (Central Business District 2), Secondary Zoning RS (Retail Sales), Third Zoning W (Warehouse), and Fourth Zoning CM/E, so a pawnshop is a by-right use in those four districts without needing a conditional use permit from the planning and zoning commission. Notably, pawnshops are not listed among the uses permitted in CBD-1, the more restrictive downtown-core district, unlike some retail uses that reach all four commercial tiers.

Section 53-693.3 goes further and specifically bars 'pawnshops, including title pawn, and pawnbrokers' from the O/I (office/institutional) district, grouping them with bail bond offices, check-cashing establishments and cash-advance businesses as uses excluded from O/I whether operated as a primary business or as an accessory use, and whether the activity happens indoors or outdoors. A pawnbroker that wants to locate in O/I has no exception written into Section 53-693.3; the operator would need a site in CBD-2, RS, W or CM/E, or a rezoning application. Kyle's Planning and Community Development department handles the zoning and building-permit side of opening a pawnshop within city limits, separate from any state-level transaction rules a pawnbroker must follow.
