Wylie Code of Ordinances § 26-105(a) makes it an offense to operate a sexually oriented business, other than an adult bookstore or video store selling merchandise strictly for off-site use, within 1,000 feet of a church, a public or private elementary or secondary school or school zone, a residential district boundary, a public park, or the property line of a residentially used lot. Subsection (b) separately bars establishing, substantially enlarging or transferring ownership of a sexually oriented business within 1,000 feet of another one, and subsection (c) bars operating more than one such business in the same building or structure.

Measurement runs in a straight line without regard to intervening structures, per subsection (d), and businesses lawfully operating before the 1993 ordinance that violate the spacing rules become nonconforming uses that must cease within one year under subsection (f). Section 26-112(a) sets the penalty for a spacing violation at a fine up to $2,000.00, escalating to a Class A misdemeanor for nude model studios and sexual encounter centers under subsection (b), while other article violations are capped at $500.00 under subsection (c). Beyond location, § 26-131(a) makes it an offense to operate any sexually oriented business without a valid license issued by the city, and § 26-106 allows an applicant denied for a location violation to seek an exemption from the board of adjustment within ten days, which the board may grant only after finding the location will not harm nearby property values or public safety.
