Lake Elsinore, CA Business Licensing & Operations: Pawnbrokers (2026)

Any pawnshop, secondhand dealer, or business that loans money against pledged personal property in the City of Lake Elsinore must hold a business license under LEMC Section 5.16.140, with the license fee set by City Council resolution rather than fixed in the ordinance. Before that license can be issued, the applicant must present the City with a certificate of clearance from the Chief Law Enforcement Officer and from the California Department of Justice confirming the business conforms to all City and State laws and regulations, a screening step not required of most ordinary retail licenses.

Section 5.16.110 places pawnshops and secondhand dealers within the "miscellaneous" business license classification alongside swap meets, wrecking yards, tattoo parlors, and similar specially regulated uses. The Municipal Code's zoning glossary separately defines a "pawn shop" as an establishment that lends money at a specified rate of interest on articles of personal property left as security, and it specifically excludes gun sales from that definition unless a conditional use permit application for gun sales is filed with, reviewed, and approved by the Planning Commission, meaning a pawnbroker who also wants to buy or sell firearms needs separate discretionary land-use approval on top of the business license and law-enforcement clearance.

Chapter 5.28's cumulative remedies provision applies here as it does to every other business category: paying a fine or facing prosecution for operating without the required license or clearance does not relieve the pawnbroker of the underlying duty to obtain the license and pay the fee.
