Broomfield, CO Business Licensing & Operations: Tobacco Retail License (2026)

Chapter 5-29 of the Broomfield Municipal Code defines "electronic smoking device" broadly enough to cover e-cigarettes, e-cigars, e-pipes, e-hookahs and vape pens, and folds ESDs into the definition of "tobacco product" (§ 5-29-020). Section 5-29-030 makes it unlawful for any person to act as a tobacco product retailer, including vape retailing, without first obtaining a license for each fixed location; licenses cannot authorize sales from vehicles, and no license may issue within 500 feet of an elementary, middle or high school, measured property line to property line, unless the location was already operating lawfully on February 11, 2022.

Retailing from residentially zoned or used property is also barred outright. Applications go through the city manager or designee on a city-supplied form with a non-refundable fee (§ 5-29-050), and denials may be appealed to the local licensing authority within 45 days (§ 5-29-060). Licenses run one year and must be renewed, with fee, at least 45 days before expiration or sales must stop (§ 5-29-070). Section 5-29-040 bars self-service tobacco/vape displays, requires ID checks and age-21 signage, and forbids anyone under 18 from making sales. The Broomfield Police Department and its designees conduct compliance checks (§ 5-29-090), and unlicensed retailing is declared a per se nuisance under § 5-29-030(F).
