Article V of Chapter 15 governs how private property owners in the City of Kenner deal with unauthorized vehicles left on their lots. Section 15-77(a) gives the owner, lessee, or person in control of any private property the right to have an unauthorized vehicle towed away at the vehicle owner's own expense, with the towing and storage responsibility otherwise falling on the property owner unless another provision of the chapter applies. Section 15-77(b) offers an alternative: the property owner can instead have the vehicle booted by a booting service operator that is duly licensed under this article, with the cost of booting charged to the owner or operator of the unauthorized vehicle rather than the property owner.

A motorist who is booted keeps a right to challenge the fee by filing an action against the booting service operator in the justice of the peace court or another court of competent jurisdiction. The city licenses booting service businesses, vehicles, and attendants separately through the department of inspection and code enforcement under Sections 15-84 through 15-92, requiring an annual two-hundred-fifty-dollar business license, a twenty-five-dollar vehicle permit, and a fifty-dollar attendant certificate, plus insurance and a surety bond. Kenner's code does not create a parallel city license specifically for towing companies; a property owner arranging a straight tow, rather than a boot, instead falls back on the notice and posted-sign requirements tied to unauthorized parking in Section 15-55.3 and on the state Louisiana Towing and Storage Act for the mechanics of the tow itself.
