Volusia County requires building permits for all in-ground pools, spas, and above-ground pools over 24 inches deep. FL Building Code 7th Ed. Ch. 4 and FL §515 Residential Swimming Pool Safety Act apply.
Unincorporated Volusia County follows Florida's strict pool barrier law (FL §515). Pool barriers must be at least 48 inches tall. Fence permits are still required when fences serve as pool safety barriers, even though the county removed general residential fence permit requirements.

515.29 Residential swimming pool barrier requirements. - (1) A residential swimming pool barrier must have all of the following characteristics: (a) The barrier must be at least 4 feet high on the outside. (b) The barrier may not have any gaps, openings, indentations, protrusions, or structural components that could allow a young child to crawl under, squeeze through, or climb over the barrier....
Florida's Residential Swimming Pool Safety Act (FL §515) applies in unincorporated Volusia County. At least one additional safety feature beyond the barrier is required. Anti-entrapment drain covers are mandatory. Pools in flood hazard areas must comply with additional FBC requirements.
Above-ground pools in unincorporated Volusia County require building permits. Pool setbacks for structures under 500 sq ft are less than principal structure setbacks but pools may only be in rear or side yards per Sec. 72-277(a)(4). Same FL Building Code barrier requirements apply.
Volusia County requires building and electrical permits for hot tub installation. Florida Pool Safety Act (FL §515) applies if barrier bypassed. Locking safety cover meeting ASTM F1346 satisfies barrier requirement.
