Oldham County, KY Environmental Rules: Erosion Control (2026)

Chapter 153, the Construction Site Runoff Control Ordinance, applies to unincorporated Oldham County and to incorporated areas that are co-permittees on the county's KPDES MS4 permit (§ 153.01). Under § 153.10, a person must obtain a stormwater quality management permit from the county before starting any land-disturbing activity that disturbs one acre or more, and must submit a stormwater pollution prevention plan (SWPPP) sealed by a licensed engineer or land surveyor, with BMPs at least as protective as Kentucky's general construction stormwater permit KYR100000. Section 153.07 requires a perimeter control plan secure the site perimeter before land disturbance begins, using vegetated strips, sediment barriers, diversion berms or sediment basins to protect adjacent properties and discharge points; clearing beyond what is needed to install perimeter controls cannot start until those controls are installed and stabilized, per § 153.08.

The county must inspect within seven calendar days of plan submittal, or the permittee may begin work. Section 153.05 exempts agricultural and silvicultural operations under an approved water quality plan, surface mining reclamation projects, additions to existing single-family homes, and redevelopment disturbing less than 2,500 square feet. Fees under § 153.11 are $100 per lot for single-family residential development, or $100 per acre of disturbance up to $2,500 for other land uses. Qualified professionals registered with the county must perform maintenance inspections at least every seven days, or every 14 days plus within 24 hours of a half-inch storm, under § 153.12.
