Summary
No one may fill, grade, build or otherwise develop land inside a Greece special flood hazard area without a floodplain development permit from the Building Inspector, who serves as the chapter's Local Administrator under the Town's 2024 Flood Damage Prevention law, Chapter 117.
A floodplain development permit is hereby established for all construction and other development to be undertaken in areas of special flood hazard in this community for the purpose of protecting its citizens from increased flood hazards and insuring that new development is constructed in a manner that minimizes its exposure to flooding. It shall be unlawful to undertake any development in an area of special flood hazard, as shown on the Flood Insurance Rate Map enumerated in § 117-6 (Basis for establishing areas of special flood hazard), without a valid floodplain development permit.

Chapter 117, readopted June 20, 2024 by Local Law No. " Applications go on forms furnished by the Local Administrator, who under Section 117-11 is the Building Inspector, and must show the nature, location, dimensions and elevations of the site plus existing or proposed structures, fill, storage of materials and drainage facilities. Section 117-12B requires an application fee set from time to time by the Town Board, and the Local Administrator may require a deposit of no more than $500 to cover the Town's added review, inspection and approval costs.
Section 117-5 extends the chapter to all special flood hazard areas within Town boundaries, and Section 117-6 bases those areas on the Flood Insurance Rate Map and Flood Insurance Study for Monroe County, incorporated by reference along with the accompanying Attachment 1 floodplain district map. Property owners denied a permit, or seeking relief from a standard, can appeal to the Zoning Board of Appeals under Article VI, which may grant a variance subject to conditions in Section 117-24.

Section 117-9 makes any unpermitted construction, excavation or fill in a special flood hazard area an offense punishable, on a first conviction, by a fine of up to $1,000 or up to six months in jail, or both; a second offense within five years raises the fine to $1,000 to $5,000, and a third or later offense within five years raises it to $2,500 to $10,000, each still carrying up to six months in jail. Every week a violation continues is a separate offense, and a noncompliant structure without an approved variance is reported to FEMA.
