Greece, NY Environmental Rules: Stormwater Management (2026)

Town Code Chapter 176 (Stormwater Management), adopted December 18, 2007 by Local Law No. 5-2007, splits stormwater regulation into MS4 discharge controls (Article II) and land-disturbance/SWPPP review (Article III and IV). Under § 176-19, any applicant seeking site plan approval or a permit for land disturbance of one or more acres must submit a Stormwater Pollution Prevention Plan (SWPPP) that the Stormwater Management Officer reviews and approves before final approval issues; no permit or site plan approval can be granted for that scale of disturbance without SWPPP sign-off.

Smaller land-disturbance activities not otherwise subject to site plan or permit review must still submit a SWPPP for the Officer's approval. Exemptions under § 176-19B cover declared emergencies, agricultural and silvicultural activity (except log haul roads and landing areas), routine maintenance disturbing under five acres, and Town-directed repairs to stormwater treatment practices. Section 176-20 requires a financial guarantee, sized to the estimated construction cost of the stormwater and erosion-control practices plus a contingency, before the Town issues approval, with forfeiture provisions if the work is not completed as specified in the SWPPP.

Fees are set by the Town Board and must be paid before scheduling a preconstruction meeting under § 176-24. Separately, Article II bars illegal discharges and illicit connections to the municipal storm sewer system, enforced through inspection powers granted to the Chief Engineer under § 176-7.
