Ogden, UT Environmental Rules: Stormwater Management (2026)

Ogden City Code title 9, chapter 7, article D governs non-storm water discharges into the city's municipal separate storm sewer system (MS4). Section 9-7D-1 applies the article to all water entering the storm drain system or the waters of the State of Utah from any developed or undeveloped land in Ogden City, unless exempted. Section 9-7D-2 prohibits discharging or causing to be discharged into the storm drain system or watercourses any pollutants that violate applicable water quality standards, other than storm water itself. The code carves out specific exemptions: water line flushing, irrigation and lawn watering runoff, diverted stream flows, uncontaminated ground water, air conditioning condensation, individual residential vehicle washing, dechlorinated swimming pool discharge, and firefighting flows, among others listed in subsection B.

Section 9-7D-3 separately bans illicit connections, including any line conveying sewage into the MS4, regardless of when the connection was made. The authorized enforcement officer, designated by the mayor, may suspend a violator's MS4 access without notice during an emergency discharge under section 9-7D-4, and may issue a written notice of violation under section 9-7D-10 requiring permit compliance, cleanup, or civil penalty payment. A person served with a notice may appeal to the city recorder's office within ten days under section 9-7D-11, with hearings conducted under title 4, chapter 4, article A.

Violations left uncorrected after appeal authorize the enforcement officer to enter private property and abate the condition under section 9-7D-12, with the cost recoverable from the owner. Section 9-7D-14 further declares any violation a public nuisance subject to civil abatement action.
