Jupiter, FL Fence Regulations: Material Restrictions (2026)

Section 27-1326(4) of the Code of Ordinances, part of the same "Fences, walls and hedges" section that sets height limits, addresses what a residential fence can be made of rather than how tall it can be. It flatly prohibits walls, fences, hedges or similar barriers or enclosures erected in any residential district from containing any substance such as broken glass, spikes, nails or similar materials designed to inflict pain or injury to any person or animal. The prohibition is written broadly around the purpose of the material, injuring a person or animal, rather than a fixed list, so it reaches homemade toppers and improvised barriers as well as manufactured products.

It sits alongside the permit requirement in section 27-1326(b), which requires any fence or wall enclosing a permitted use, other than primary agricultural uses, to go through the town's building permit process; a plan showing broken glass, spikes or similar hazards on top of a fence would not clear that review. The identical prohibition is repeated, with "razors" added to the example list, at section 27-1363(4) for the Residential Compact Single-Family District (R-1A), confirming the standard runs across the town's residential zoning districts rather than applying to only one of them.

The code does not separately name barbed wire or electric fencing; those are addressed, if at all, only to the extent they meet the "designed to inflict pain or injury" standard, which the building official applies case by case.
