Ramapo, NY Fence Regulations: Neighbor Fence Rules (2026)

Section 376-52C, part of the Zoning Law's side and rear yard exceptions, sets the default rule that every fence's outer face sits at least one foot from the property line, so a neighbor is not left staring at fence posts and rails. That default can be waived only one way: a common fence may be constructed on the property line with the written consent of both abutting owners. Absent that signed consent, a Ramapo property owner cannot force a fence onto the shared line, and the code separately requires that whichever side is built, the outer or better-appearing face must point toward the abutting property or street rather than toward the fence owner's own yard.

The section does not create a cost-sharing or maintenance obligation between neighbors for an existing boundary fence; it only governs where a new fence may be located and which face must be turned outward. The same written-consent mechanism appears immediately afterward in § 376-52D for accessory buildings placed on a common side or rear lot line, so Ramapo's Zoning Law treats a shared fence and a shared shed wall the same way: neither is allowed on the line without both owners' signed agreement.
