Cumberland County Zoning Ordinance Section 1102 C states that 'The setback requirements of this ordinance shall not apply to any retaining wall.' A retaining wall may therefore be placed within a required front, side, or rear yard on unincorporated land. Where a wall element functions as a solid fence, the three-foot front-yard and seven-foot side/rear-yard solid-fence limits of Section 1102 C still control the visible fence portion. Structural engineering and grading of the retaining wall are governed by the North Carolina State Building Code; a county zoning permit remains required for the associated work. Municipalities regulate retaining walls within their own limits.
A fence-height violation on a wall used as a solid fence, or work without required permits, is a zoning violation carrying a $500 civil penalty per day (Section 1704).
