The city may restrict vending within certified farmers' market areas during market operations, in parks where exclusive vendor contracts exist, and near special events with temporary food vendor permits. Sidewalk vendors must not block pedestrian access and must maintain a minimum clear path of 4 feet on sidewalks per ADA requirements. Vendors must have a valid business license, applicable health permits from the Orange County Health Care Agency, and a California seller's permit. Vending from vehicles on public streets is regulated separately under Municipal Code Chapter 5.44. The city may establish specific no-vending zones near schools during school hours, in areas with heavy pedestrian traffic where safety concerns exist, and where vending would obstruct emergency access. Vendors must remove all equipment and clean the area at the end of each vending day. SB 972 further clarified that violations are administrative, not criminal.
Under SB 946, first violations result in a warning. Subsequent violations may result in administrative fines of $100 for the first citation, $200 for the second within one year, and $500 for the third and beyond. Violations cannot be charged as misdemeanors. Operating without a health permit is enforced separately by OCHCA.
