Under LEMC 17.415.130, small family day care homes (8 or fewer children) and residential care facilities are a permitted use in all residential zones. Large family day care homes (9 to 14 children) require a residential care permit with 100-foot neighbor notice.
LEMC 17.415.130 implements California's protection of family day care as a residential use. A small family day care home (eight or fewer children) and a residential care facility serving six or fewer persons are a permitted use in all residential zones if the structure meets the zone's standards (LEMC 17.415.130.C); the R-1 district lists these among permitted uses (LEMC 17.76.020). A large family day care home (nine to 14 children) needs a residential care permit (LEMC 17.415.130.D), processed under Chapter 17.410 LEMC, with notice mailed at least 10 days prior to owners within a 100-foot radius. Standards (LEMC 17.415.130.E) require a six-foot wood fence or masonry wall along side and rear lines behind the front setback, plus adequate parking.
Operating a large family day care home without the required residential care permit, or without the six-foot side/rear fencing and parking, is a zoning violation enforceable by Code Enforcement under Title 17 LEMC. State licensing is separately required.
