Town of Davie Code Sec. 12-34(N)(1) defines a home occupation as 'an occupation, business, profession or trade, including a cottage food operation, which operates in whole or in part from a residential dwelling unit on residential property.' Section 12-34(N)(2) limits home occupations: (a) as viewed from the street, the residential lot and dwelling 'shall remain consistent with the residential character of surrounding residential lots,' and any external modifications must conform to the neighborhood's residential character and architectural aesthetics; (b) retail transactions must be conducted only within the residential dwelling, though incidental business activities may occur throughout the lot; (c) employees who work at the dwelling must also reside there, except up to two (2) nonresident employees or independent contractors may work at the business, plus unlimited remote employees; (d) parking must meet the residential parking requirements of Article VII and may not generate more parking demand than a similar residence with no home occupation; (e) parking of commercial vehicles, trailers, and equipment must meet Code Sec. 12-33(G); and (f) vehicles and trailers used for the business must be parked in legal spaces, not in a right-of-way, on a sidewalk, or on unimproved surfaces. These provisions mirror Florida's home-based business preemption statute, Fla. Stat. 559.955, which bars local governments from regulating home-based businesses more strictly than other residences.
Operating a home occupation that changes the residential character of the lot, conducts retail outside the dwelling, exceeds two nonresident employees, or parks commercial vehicles/trailers in violation of Sec. 12-33(G) violates Davie Code Sec. 12-34(N) and is enforceable by Davie Code Compliance. A Broward County / Town of Davie business tax receipt is also required to operate.
