Critically, Sec. 12-34(J)(6) requires the home to meet the minimum standards of the Broward County Family Day Care Home Licensing Ordinance (Broward County Ordinance No. 90-33, as amended), and Sec. 12-34(J)(7) requires an applicant seeking a home business tax for a family day care home to first submit a copy of a duly authorized license from the Broward County Social Services Division before the business tax is issued. Family day care home licensing in Florida is otherwise administered through DCF/Broward County; Davie's role is the zoning allowance plus the business tax tied to the county license.
Operating a family day care home that exceeds the child limits in Sec. 12-34(J) without the required child care facility license (Fla. Stat. 402.302(4)), or without the Broward County family day care home license required by Sec. 12-34(J)(6)-(7), violates the Davie code and is enforceable by Code Compliance; the Town will not issue the business tax without proof of the Broward County license.
