Key zoning limitations include: the smaller of 25% or 750 square feet of the dwelling's gross floor area may be used for the home occupation (Sec. 4.12.A); accessory buildings and structures may not be used for the home occupation (B); excluded uses include auto repair or sales, restaurants, keeping of animals, funeral homes, retail or wholesale shops, motel-type establishments, taxi services, and any other occupation found incompatible with the ordinance (D); no home occupation may generate offensive traffic, sound, smell, vibration, light, or dust (F); no more than two clients or patrons may be on the premises at the same time, except a Family Day Care Home may have up to six in care (G); vehicles kept on site must be used by residents only (H); transporting goods by truck is prohibited, and related vehicles must park within the driveway or on-site parking (I); and no home occupation may be operated so as to create or cause a nuisance (P). The home occupation provisions come from the city's own code, not Georgia state law, though state law governs licensed home-based child care.
Operating a home occupation that exceeds the floor-area limit, employs non-residents, draws excessive client traffic, or causes a nuisance is a zoning violation subject to code-compliance enforcement and possible denial or revocation of the related occupation tax certificate.
