Running a business from home in the City of Muncie requires a special use approval, not just a passing mention on your tax return. Muncie City Code § 150.222(A) defines a home occupation narrowly: an occupation conducted in a dwelling by a member of the resident family, where clients come to the property, and the section expressly excludes rummage, yard, porch, or garage sales from the definition. Section 150.222(B) limits where the use can even be considered: the F Farming Zone or any residence zone; it is not an option in a business or industrial district.

Because a home occupation is a special use under §§ 150.215 through 150.224, the owner files an application with the Delaware-Muncie Metropolitan Board of Zoning Appeals under the procedure in § 150.216, and the plan commission reviews and reports to the board before a public hearing is held. Section 150.222(C) then sets the operating conditions: under (C)(1) the operator must remain a resident and only resident family members may work in the business, and under (C)(2) the dwelling's primary use must stay residential, with the home occupation clearly incidental and subordinate.

The floor-area cap in (C)(4) limits the business to 25 percent of the dwelling. Approval does not run with the deed: § 150.222(C)(9) states the special use grant does not transfer with ownership or to another location, so a new owner must reapply. Section 150.222(C)(10) also carves out uses the city will never approve as a home occupation, including clairvoyance, fortune telling, chemical experimentation, hobby or curio shops, nursing homes, tourist homes, and gun shops. A violation of the zoning code's home-occupation standards falls under the citywide general penalty of Muncie City Code § 10.99, a fine of not more than $2,500.00 per offense.
