Vacaville requires a Home Occupation Permit under VMC 14.09.270 plus a city Business License before operating a home-based business. Home occupations are limited to 20% of the dwelling's floor area, must be incidental to residential use, cannot generate customer traffic, and cannot involve outside employees. California AB 1472 (Gov. Code 65852.2 family day care) and AB 587 / SB 1100 frame state-level limits on local prohibitions.
VMC 14.09.270 governs Standards For Specific Uses and Activities, including home occupations. The standards apply to any residential unit in Vacaville regardless of zoning designation, and to agricultural districts. Family day-care homes are excluded - they are regulated separately by California Health & Safety Code 1597.30 et seq. and California Government Code 65852.2 (now Gov. Code 66310) which preempts local family-day-care prohibitions for small (up to 8 children) and large (up to 14 children) family day-care homes. Key Vacaville home-occupation standards: (1) the business must be conducted entirely within the dwelling, with no outdoor storage of equipment, supplies, or vehicles related to the business; (2) no more than 20% of the dwelling floor area may be dedicated to the home occupation; (3) only members of the household residing in the dwelling may engage in the business activity - no outside employees coming to the residence; (4) no client/customer visits for the procurement of goods or services; (5) only occasional postal/parcel deliveries by standard residential carriers; (6) no signs visible from outside the dwelling; (7) no display of stock-in-trade in any window; (8) no noise, vibration, smoke, dust, odors, heat, glare, or interference with radio/TV/wifi reception detectable beyond the dwelling. AB 1472 (Gov. Code 1597.30 et seq.) preempts these for state-licensed day care. AB 587 / SB 1100 (Gov. Code 7282.5 limits) frame state-level commercial-cannabis preemption questions. Home occupations must obtain both the Home Occupation Permit (Planning) and the city Business License (Finance Department).
Operating a home occupation without a permit violates VMC 14.09.270 and VMC 5.04 (Business License). Vacaville Code Enforcement issues notices of violation, administrative citations under VMC Title 8 Chapter 8.10 ($100 first offense escalating to $500+), and cease-and-desist orders. Exceeding the 20% floor-area limit, bringing in non-resident employees, or attracting customer traffic triggers progressive enforcement. Operating without the city Business License is a misdemeanor under VMC 5.04 with separate fines.
