Section 133-9H targets noise in connection with the operation of any commercial establishment or enterprise rather than a specific device, covering the music, crowd noise and sound systems associated with bars, restaurants and nightclubs. The test is measured inside any receiving property's dwelling unit, not at the property line: once the sound level there exceeds the increase permitted by Table IV under § 133-8, a 3 dB(C) rise on weeknights from 10:00 p.m. to 7:00 a.m. and 6 dB(C) on weekend nights, the noise is flatly prohibited, without a separate warning period built into the section itself.

Because the measurement point is inside the neighbor's unit, a residential tenant living above or beside a nightlife venue can document a violation with a Noise Control Officer's in-unit reading rather than a street-level check. Enforcement runs through the same officers named in § 133-2: Hoboken's Building Code Official, Zoning Officer, Health Officer, Environmental Health Specialist, Public Health Nuisance Investigator, the Police Department and the Office of Emergency Management, any of whom may issue a notice of violation or penalty assessment under § 133-11.
