Avondale, AZ Noise Ordinances: Aircraft Noise (2026)

Aircraft noise sits largely outside local authority. Under longstanding federal law, the regulation of aircraft in flight is preempted by the federal government, with the Federal Aviation Administration controlling flight operations, routes and altitudes, and noise standards. As a result, Avondale's City Code does not, and legally cannot, set noise limits on aircraft overflights, and Section 15-11 is directed at community and ground-source noise rather than airplanes or helicopters in the air. New local airport noise restrictions are further constrained by the federal Airport Noise and Capacity Act and its Part 161 review process, which requires a cost-benefit analysis before most new restrictions can take effect. At the state level, Arizona addresses aircraft noise mainly through disclosure rather than operational limits: the public airport disclosure framework in state law requires recording of airport-influence and noise maps to inform homebuyers near public airports. Residents disturbed by aircraft noise generally must direct concerns to the operating airport or the FAA rather than to Avondale code enforcement, since the city has no enforcement authority over aircraft in flight.
