Avondale Code Section 15-11(c)(2) prohibits playing any radio, sound reproduction device or musical instrument at a volume that annoys or disturbs the comfort or repose of nearby residents. Reasonable noncommercial public-address use is exempt.
Amplified music and sound are directly addressed in Avondale's noise ordinance. Section 15-11(c)(2) declares it a prohibited noise to play 'any radio, sound reproduction device or any musical instrument in such a manner or with such volume as to annoy or disturb the quiet, comfort or repose of persons in any hospital, office, retail establishment, dwelling, hotel, or other type of residence, or of any persons in the vicinity.' Related provisions reach amplified sound used for advertising or attention: Section 15-11(c)(10) bars using a 'drum, loudspeaker or other instrument or device' to draw attention to a show, sale or display, and Section 15-11(c)(11) prohibits 'mechanical loudspeakers or amplifiers on automobiles, trucks, busses, or other moving or standing vehicles for advertising or other purposes.' The ordinance carves out an exemption in subsection (d) for 'the reasonable use of amplifiers or loudspeakers in the course of public addresses which are noncommercial in character,' protecting speech-oriented uses. The code sets no numeric decibel threshold for music; enforcement turns on whether the volume unreasonably disturbs people nearby. A violation is a misdemeanor.
Playing amplified music loud enough to disturb nearby residents is a misdemeanor under Section 15-11. Vehicle-mounted loudspeakers used for advertising are separately prohibited.
