Fresno Municipal Code section 10-109(a) exempts permitted construction, remodeling, site preparation, and grading from the Noise Ordinance only when the work takes place between 7:00 a.m. and 10:00 p.m. on any day except Sunday. Construction equipment such as pile drivers, hammers, saws, and drills is otherwise listed among the regulated noise sources in section 10-105(d).
Fresno's construction-noise rule is structured as an exception to the general Noise Ordinance. Section 10-105(d) places 'construction equipment or work, including the operation, use or employment of pile drivers, hammers, saws, drills, derricks, hoists, or similar construction equipment or tools' squarely within the list of regulated noise sources. Section 10-109 then exempts that activity from the article's restrictions only within fixed windows: subsection (a) exempts 'construction, repair or remodeling work accomplished pursuant to a building, electrical, plumbing, mechanical, or other construction permit issued by the city or other governmental agency, or to site preparation and grading, provided such work takes place between the hours of 7:00 a.m. and 10:00 p.m. on any day except Sunday.' In practical terms, permitted construction noise is allowed Monday through Saturday from 7 a.m. to 10 p.m., is not exempted on Sundays at all, and emergency work is separately exempt under subsection (b). Work performed outside these windows loses the exemption and is judged against the section 10-102(b) decibel limits and the section 10-105 reasonable-person standard.
Construction noise outside the 7 a.m.-10 p.m. window, or on Sunday, is no longer exempt and is enforceable as a Noise Ordinance infraction; persistent violations may be abated as a public nuisance by injunction under section 10-111.
