Sec. 58-30(8) exempts commercial and non-commercial power tools and landscaping and yard maintenance equipment from the decibel limits between 7:00 a.m. and 7:00 p.m. on weekdays and 7:00 a.m. and 8:00 p.m. on weekends and federal holidays. Two conditions attach: the equipment may not be operated so the sound is plainly audible at a residential property line or at the property line of a noise sensitive receiver between 8:00 p.m. and 8:00 a.m., and all motorized equipment used in these activities must be operated with a muffler. Outside the exemption window, a leaf blower is measured against the ordinary limits in Sec. 58-28 โ 55 dBA daytime and 50 dBA nighttime at a residential property line.
Noise violations carry up to $500 or 30 days for a first offense, $750 or 60 days for a second, and $1,000 or 90 days for a third.
