Development Code Section 9.210.060(F)(1) sets special standards for motor vehicles. Off-highway vehicles must be equipped with a USDA-qualified spark arrester and a constantly operating, properly maintained muffler with no cutout or bypass, and may not emit more than 96 dBA (vehicles manufactured on or after January 1, 1986) or 101 dBA (manufactured before 1986), measured 20 inches from the tailpipe under SAE Standard J-1287. Motor vehicle sound systems, whether affixed to the vehicle or not, may not be operated between 10:00 p.m. and 8:00 a.m. so as to be audible inside any inhabited dwelling, and at any other time may not be audible more than 100 feet from the vehicle. Factory-equipped motor vehicles themselves are exempt from the general noise standards, but that exemption expressly excludes sound systems (Section 9.210.060(B)(9)). On public roads, California Vehicle Code Sections 27150-27151 (mufflers, modified exhaust over 95 dBA) remain enforceable by police.
Each special sound source standard violated is a separate violation of the noise chapter, punishable as a misdemeanor under Chapter 1.01 or by administrative citation under Chapter 1.03. Exhaust violations on public streets can also draw California Vehicle Code citations.
