408, in Article 4 of the Chapter 9 traffic code, dates to Ordinance No. 911, effective October 7, 1982, and has never been amended. It provides that no person or agency, unless authorized by the Public Works Director, shall paint any street or curb surface, with a narrow exception for curb-number stenciling by someone who has complied with a separate City ordinance or resolution covering that practice, and that any unauthorized curb painting is removed at the violator's expense. 408 locks out anyone else from applying paint to a curb in the first place.

A homeowner who paints a house number on the curb without going through the City's separate approval process for that practice is not covered by the exception; only someone who has followed an existing ordinance or resolution authorizing curb-number painting, such as through an assessment district, qualifies. Enforcement runs through Public Works and the Police Department, and remediation costs are billed back to the person or firm responsible rather than absorbed by the City.
