Full Breakdown
Section 405.02(7) of the Roseville City Code declares the outside parking or storage of vehicles, materials, supplies or equipment on residentially-zoned property a public nuisance when it violates the listed standards. Subsection (7)b applies to the front yard or the unscreened street-facing side yard of a corner lot in any residential zoned area. Trailers of any type are allowed there only if completely placed on an improved surface, as defined in the Code, and stored no closer than five feet of a property line. Boats or watercraft of any type in excess of 20-foot length are barred from those areas. Recreational vehicles, as defined by state statutes, must be stored completely on an improved surface, meet a five-foot setback to a property line, and no portion can be on or over the public right-of-way. The same subsection also bars inoperable vehicles and vehicles posted as for sale from those yard areas.
Subsection (7)d sets the general parking test for residential property: vehicles must be on an improved surface, and they must be owned by a legal resident of that property who continuously maintains current registration and licensure.
Subsection (7)f governs the street. No trailer of any size, boat supported on a trailer, or recreational vehicle with dual rear tires or dual rear axle can be parked on a public street or right-of-way for more than four consecutive days, or for more than four total days in any calendar month. Parking in one location for over two hours in a 24-hour period counts as a day.
Under Section 405.06 the community development director administers Chapter 405. Section 405.07 requires written notice that describes the nuisance, specifies the steps to abate it and sets a deadline not exceeding 30 days, served in person, by regular or certified mail, or by posting on site.
Violations & Fines
Section 405.05 makes it unlawful to maintain any public nuisance defined in Chapter 405. A Code violation is a misdemeanor under Section 102.01(a), with a fine not to exceed $1,000.00, imprisonment not to exceed 90 days, or both. Section 102.01(c) also allows an administrative offense, with penalties set in the city fee schedule and a 100 percent increase for a repeat within 18 months, applied twice at most.
